An El Paso County Judge has issued a ruling on whether or not to allow a ballot issue regarding recreational marijuana in Colorado Springs.

An amendment in the Colorado Constitution requires local ballot measures banning recreational marijuana to be during a general election in an even-numbered year.

According to the ruling, the Colorado Constitution says that municipal marijuana-related ballot items must appear on general election ballots in even-numbered years. The upcoming April municipal election does not meet those requirements.

District Court Judge Hilary Gurney ruled that because the repeal would effectively prohibit retail marijuana stores from operating in the city, the Colorado Constitution did not allow the vote
